Help With IRS Bank Levy and Wage Garnishment
An IRS levy is a legal seizure of property to collect an unpaid tax debt. The IRS can levy money in a bank account, garnish wages, take certain payments owed to you, and levy other property or rights to property. The IRS explains the types of property subject to levy and its levy procedures here.
ReGen can assist when:
- You received a Final Notice of Intent to Levy
- Your bank account has been frozen by an IRS levy
- The IRS is garnishing your wages
- Your employer received an IRS wage levy
- The IRS has levied business income or accounts receivable
- A levy is preventing you from paying necessary living or business expenses
- You need representation to address an active or threatened IRS collection action
The appropriate response depends on where you are in the collection process, the notices the IRS has issued, your financial circumstances, and the underlying tax liability.
IRS Bank Levy Relief
A bank levy generally captures funds in the account when the bank receives the levy. The bank then holds those funds for 21 days before sending them to the IRS, giving the taxpayer a limited period to address certain issues with the IRS. See the IRS rules for bank levies.
If your bank account has already been levied, timing matters.
ReGen can review the levy, communicate with the IRS on your behalf, determine whether grounds exist to request a release, and evaluate what collection alternative may address the underlying tax debt.
IRS Wage Garnishment Relief
An IRS wage levy is different from a typical one-time bank levy. Once served on an employer, a wage garnishment generally continues to attach to wages each pay period until the tax is paid, another arrangement is made, or the levy is released. A portion of wages is exempt, but the amount depends on the applicable IRS calculation. The IRS provides additional information about wage levies here.
ReGen can communicate with the IRS regarding an active wage garnishment, evaluate whether the levy should or can be released, and work toward an appropriate resolution of the tax liability.
Getting an IRS Levy Released
A levy release isn’t the same as resolving the tax debt.
Depending on the circumstances, the IRS may release a levy because the liability has been paid, an appropriate payment arrangement has been established, the collection period has expired, the levy is creating an economic hardship, or another statutory basis for release applies. The IRS lists the circumstances under which a levy may be released.
If a levy is released while the tax debt remains unpaid, the next step is determining how that debt will be resolved.
That may involve an installment agreement, Currently Not Collectible status, an Offer in Compromise, or another collection alternative depending on the facts of the case.
At ReGen, we look at those issues together. The goal isn’t simply to obtain temporary relief from a levy while leaving the underlying collection problem untouched.
